General Terms and Conditions  -  Gift Certificates

1. These Terms and Conditions govern the relationship between you and Smartwings, a.s., ID No. 25663135, K Letišti 1068/30, Postal Code 160 08, Prague, Czech Republic (hereinafter referred to as "Smartwings").
2. By purchasing a Gift Certificate, you express your full acceptance of these Terms and Conditions, which have been made available to you at the time of purchase and which are also available at www.smartwings.com.
3. After purchasing a Gift Certificate, you will receive an order confirmation and payment confirmation in your email inbox. 
4. Gift Certificates are non-refundable and cannot be exchanged for cash or transferred against value. Likewise, the resale of Gift Certificates is not permitted. 
5. The recipient of the Gift Certificate will receive the Gift Certificate in their email inbox which will contain the Gift Certificate number, PIN and a link to the Terms and Conditions.
6.  Gift Certificates can be redeemed online at www.smartwings.com.
7. Smartwings will issue an e-ticket for scheduled flights of your choice including taxes based on the Gift Certificate received. The Gift Certificate can also be used to purchase additional services for a new or existing booking.
8. To purchase a ticket or additional services, please make a reservation via the above mentioned website (www.smartwings.com), by entering the Gift Certificate number and its PIN in the payment section or via the contact center.
9. The Gift Certificate can be used for any flights in the booking system.
10. If the value of the services booked is higher than the value of the Gift Certificate, the difference must be paid in excess of this compensation (using standard payment methods).
11. If the value of the services booked is lower than the value of the Gift Certificate, the balance remains valid for further use with an unchanged expiry date.
12. Gift Certificates are valid for one (1) year from the date of issue. The certificate code is valid until fully redeemed by the expiry date. Any balance on the Gift Certificate will be valid for one (1) year from the date of issue of the Gift Certificate. 
13. The Gift Certificate may be used multiple times within the validity period until the total balance of the Gift Certificate is exhausted. After the expiration date, the Gift Certificate cannot be used, renewed or reactivated in any way, nor can the unused balance of the Gift Certificate be claimed or redeemed for cash. No refund or credit note will be issued for any unused portion of the Gift Certificate.
14. Gift Certificates cannot be exchanged for the purchase of additional Gift Certificates.
15. Gift Certificates are issued in CZK, EUR or USD. The value of the Gift Certificate ranges from 1000 CZK / 50 EUR /50 USD to 100,000 CZK / 4,000 EUR / 4,000 USD. The maximum amount for which Gift Certificates can be purchased in one transaction is 100 000 CZK / 4,000 EUR / 4,000 USD.
16. Gift Certificates can only be redeemed in the currency in which they were issued.
17. The name of the person for whom the ticket or additional service is purchased need not be the same as the name on the Gift Certificate. 
18. The value of the Gift Certificate is non-refundable in the event of voluntary cancellation. Changes to the reservation can be made according to the terms of the tariff.
19. In the event of cancellation by the carrier, the value of the Gift Certificate will be refunded to the provided Gift Certificate.
20. Smartwings shall not be liable in the event of loss, theft, destruction or use of the Gift Certificate without the consent of the recipient. Neither Smartwings nor any of its agents, employees or representatives shall be obliged to require the person presenting the Gift Certificate to identify themselves. 
21. Smartwings reserves the right to modify and otherwise change these Terms and Conditions at any time in its sole discretion. Such modifications or changes shall not affect Gift Certificates already purchased.
22. Smartwings’ failure to exercise any of its rights shall not be construed as a waiver or relinquishment of any future exercise of any of its rights, and your obligations with respect to such future exercise shall remain in full force and effect.
23. Should any provision contained in these Terms and Conditions become invalid, unenforceable or prohibited in any jurisdiction, the validity and enforceability of the remaining provisions of these Terms and Conditions will not be affected. 
24. These Terms and Conditions are governed by Czech law. To the extent permitted by law, you agree to submit to the exclusive jurisdiction of the Czech courts to resolve any disputes that may arise from or in connection herewith.
